These Terms of Service ("Terms") govern your access to and use of the MockLab website (mocklab.com) and application (app.mocklab.dev) operated by MockLab ("Company", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Use of the Service

You agree to use MockLab only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service for any unlawful, harmful, or fraudulent purpose
  • Attempt to probe, scan, or test the vulnerability of any MockLab system
  • Interfere with or disrupt the integrity or performance of the Service
  • Transmit any malware, viruses, or other malicious code
  • Violate any applicable laws or regulations
  • Impersonate another person or misrepresent your affiliation with any entity
  • Use the Service to receive, store, or transmit content that violates the rights of others

2. Accounts

You must create an account to access most features of the Service. You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use at [email protected]

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3. Plans, Billing & Payment

MockLab offers free and paid subscription plans. For paid plans:

  • Billing occurs at the start of each monthly billing period
  • Payments are processed by Stripe. You authorize us to charge your payment method on file.
  • All fees are non-refundable except as required by applicable law
  • We reserve the right to change pricing with 30 days notice
  • Downgrading takes effect at the end of the current billing period
  • Failure to pay may result in suspension or termination of your account

4. Acceptable Use & Fair Use

Plans include the resource limits described on our pricing page. You agree not to:

  • Circumvent plan limits through technical means (e.g., multiple accounts, scripted automation)
  • Use the Service as a production API or data storage service without an appropriate plan
  • Generate or receive traffic that constitutes abuse or excessive load beyond reasonable use

We reserve the right to rate-limit, suspend, or terminate accounts that violate fair use policies.

5. Your Content

You retain all ownership of the data and content you submit to MockLab ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store and process Your Content solely to provide the Service to you.

You represent that you have all necessary rights to submit Your Content to MockLab and that Your Content does not violate any law or third-party rights. We are not responsible for Your Content and make no representations about it.

6. Intellectual Property

The Service, including its design, code, features, logos, and documentation, is owned by MockLab and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission. These Terms do not grant you any right to use our trademarks or brand assets.

7. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

8. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if:

  • You breach any provision of these Terms
  • We determine your account has been used for abusive or fraudulent activity
  • We are required to do so by law

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOCKLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved by binding arbitration, except you may assert claims in small claims court.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 30 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
